FormCoach Terms of Service

Definitions

1. "FormCoach" means our intelligent products developed and served by EXPOLEAP.
2. "Infrastructure Provider(s)" means third-party providers of hosting, database, storage, networking, or related infrastructure services.
3. "Third-Party AI Provider(s)" means external providers of artificial intelligence models or related services that you can access through the AI Gateway (for example, OpenAI, Google, or OpenRouter).

Commitments and statements

1. The content of the agreement may change the content according to the changes of national laws and regulations, business adjustment, product update and protection of users rights and interests, etc. The content of the changed agreement will be more in line with the business reality and better protect the rights and interests of both parties. The changed agreement will be publicized in accordance with legal procedures. If you do not agree with the change content, you have the right to contact the EXPOLEAP for the feedback before the effective date of the change content, and the EXPOLEAP will adjust the change matters according to your feedback.
2. The modified version of the agreement shall take effect upon the expiration of the announcement and shall replace the agreement version before the change.
3. You confirm that you have full capacity for civil rights and civil conduct as stipulated by law, and can independently bear civil liabilities. If you do not have the capacity for civil conduct commensurate with the foregoing, you and your guardian shall bear the consequences arising therefrom in accordance with the law.
4. The terms of this agreement signed by you with EXPOLEAP are not fully listed and cover all the rights and obligations between you and EXPOLEAP, and the existing agreements cannot guarantee that they can fully meet the needs of future development. Therefore, the rules related to this Service are supplementary agreements to this Agreement, including the FormCoach Privacy Policy, which shall be observed by you, and are inseparable from this Agreement and have the same legal effect.

Opening, provision, and termination of the service

1. This service is an intelligent service provided based on Internet technology, and the specific services shall be subject to the product and service introduction page displayed and those actually provided to you.
2. You can launch this service through our website or app, and using this service may need to pay a certain fee. The specific fee schedule shall be set forth on the relevant page. These products or Services may have limited quantities and are subject to return or exchange only according to our Refund Policy.
3. You understand and recognition, for technology upgrade, service system upgrade, or business strategy adjustment or cooperate with major national technology, laws, regulations and policies, FormCoach does not guarantee permanent provide some service, may increase according to the actual operation, cut, replace or adjust the content of the service and provide form, may also adjust the current charging method or price. Before the aforementioned modification, change or start charges, EXPOLEAP will be notified or announced on the corresponding rules or service page.
4. Early termination of the service term under any of the following circumstances:
   • Both parties agree on the early termination through negotiation;
   • You no longer meet the requirements for using FormCoach services;
   • You actively apply to EXPOLEAP to stop using FormCoach services;
   • If you violate the relevant laws and regulations or any of the commitments made under this Agreement or any other agreements or rules, you shall have the right to terminate the service in advance;
   • EXPOLEAP terminates or discontinues providing FormCoach services to you in accordance with laws and regulations or other provisions of this Agreement;
   Any suspension or termination of this Agreement shall not relieve you from compensation and liability arising from your actions prior to the suspension or termination of this Agreement.

Payment

1. If you have paid for a subscription, you have access to all paid features for free.
2. The amounts for each of our products are different, please refer to the actual fee charged. Subscription is billed monthly or annually at the rate corresponding to the selected plan. In addition, a one-time payment will be offered if needed, which is not one of the subscription plans.
3. Payment will be charged to your account at confirmation of purchase.
4. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
5. Account will be charged for renewal within 24 hours prior to the end of the current period, and identify the cost of the renewal.
6. Subscriptions may be managed by the user and auto-renewal may be turned off by going to your account settings after purchasing.
7. Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable.
8. Subscriptions can't be transferred between different systems.

Rights and obligations of the Parties

1. When using FormCoach, you may provide, upload, or generate content ("Your Content"). FormCoach does not claim ownership of Your Content and grants you full rights to use it as you wish, including for commercial purposes. However, FormCoach reserves the right to remove or block any content that violates these Terms. By using FormCoach, you grant us a license to use, store, display, and modify Your Content as needed to operate and improve the Services. This license is royalty-free, transferable, sublicensable, worldwide, and valid as long as Your Content is stored with us. We may share Your Content with third parties if necessary to provide the Services or comply with legal obligations. By submitting Your Content, you confirm that you have all necessary rights and permissions to do so and that it does not infringe on any third-party rights.
2. You guarantee that when you use the service will comply with the national and local laws and regulations, industry practices and social public ethics, will not use FormCoach services to upload, submit, storage, release, send, send, receive, spread, share the following information and content or provide convenient:
   • Any content (information) that violates national laws, regulations and policies;
   • Political publicity and / or news and information in violation of state regulations;
   • Information concerning state secrets and / or security;
   • gambling with prizes, gambling games, feudal superstition and / or obscene, pornographic, dirty information or abetting criminal information;
   • Information in violation of national ethnic and religious policies;
   • Information that impedes the security of the Internet operation;
   • Infringing the intellectual property rights of others or involving business secrets of third parties or other exclusive rights;
   • Insult, slander, intimidate, involve the privacy of others or infringe upon the legitimate rights and interests of others, and / or other information or content that is harmful to social order, public security and public morality;
   • There are viruses, Trojan horses, reptiles and other malicious software and program codes that may destroy, tamper with, delete, affect the normal operation of any system or secretly obtain the data of EXPOLEAP and other users without authorization;
   • Harassment, excessive marketing information, harm to minors information and junk information;
   • Other provisions that violate social and public interests or public morality or are based on relevant superiority intelligence establishment agreements and rules that are not suitable for the publication of superior intelligence establishment.
3. For you to use this service, upload, submit, storage, release, send, receiving, transmission or sharing of content, EXPOLEAP only in the relevant laws, regulations, national policies or the requirement of the relevant state organs, or entrust a third party to view, review, analysis, discussion, and shall have the right to provide the content to the relevant state organs review and for the purpose of its required. To review, review, analyze or discuss such content by itself or entrust a third party does not mean that EXPOLEAP shall assume any review or guarantee liability for such content, nor does it exempt you from the liability for breach of contract agreed in this Agreement due to the violation of this Treaty.
4. This Service is for your own use only, and you shall not at any time transfer, lease, borrow, share, or sell any part or all of the Services contained in this Service in any way.
5. You should guarantee against the following circumstances:
   • Use of the Service for illegal purposes or to promote dangerous activities;
   • Interference with or obstructing the server or network of or in connection with the Service, or failing to comply with any requirements, procedures, policies or regulations of any network related to or applicable to the Service;
   • Acts endangering minors;
   • Infringing on the legitimate rights and interests of any third party;
   • Other EXPOLEAP are considered harmful or improper behavior.
6. If any of your aforementioned breach of contract or your actions causes the EXPOLEAP and / or its affiliates to suffer a third party claim:
   • You agree that EXPOLEAP has the right to take one or more of the following measures: to delete, block or disconnect the relevant information, suspend or terminate part or all of the Service, or to take corrective or treatment measures against the violations or behaviors you have involved in accordance with the relevant provisions of laws and regulations.
   • if your behavior to EXPOLEAP wisdom and / or its affiliates or a third party, you shall bear the corresponding liability for compensation, liability including but not limited to the following: because of your behavior to EXPOLEAP wisdom and / or its affiliates suffered all losses (including their direct economic losses, goodwill loss and foreign payment of compensation, and payment, legal fees, costs, administrative penalties, pay to the third party and other indirect economic losses).

Disclaimer and limited liability

1. You understand and agree that the Service is provided in accordance with the existing technologies and conditions of the company. The service will do its best to ensure the accuracy and security of the service, but cannot guarantee that the service is flawless or will meet your requirements or meet your expectations. You agree that even if the services provided by EXPOLEAP are defective, the above defects will not be considered if the defects cannot be avoided by the existing technology and conditions.
2. Unless otherwise clearly provided by law, you are not liable for the service not available due to the following reasons:
   • The service is not available due to the security threat or fraud or illegal acts caused by you or the services provided by you or your end user;
   • Services caused by the equipment, software or technology of you or any third party;
   • The service is not available because you fail to configure and use the products in accordance with the provisions of the EXPOLEAP;
   • The service is not available due to your violation of any superior intelligent product rules;
   • The service is not available because you do not pay or owe money;
   • No service caused by your illegal use;
   • The service is not available due to the maintenance and upgrade of the network, hardware or service related to the service;
   • Services due to force majeure are not available;
   • The service is not available or the service is not up to standard due to the EXPOLEAP;
   • They belong to the relevant laws and regulations, relevant agreements, relevant rules or regulations, which can be exempted from liability and compensation liability, etc.
3. The content or results generated through this service are for your reference only, and you should make necessary adjustments or modifications based on the actual use scenarios, and the EXPOLEAP does not guarantee the accuracy and completeness of the output content. Between you and the wisdom should not be regarded as the establishment of any civil legal relationship such as entrustment, contracting, processing, you should bear the corresponding responsibility for the behavior and results of your use of the service.

Force Majeure

We are not liable for any failure to fulfill obligations under these Terms due to events beyond our control, including natural disasters, war, terrorism, civil unrest, or other unforeseen circumstances. Such events relieve us of our responsibilities for the duration of the disruption.

User Data

We may retain certain data that you transmit to the Services for the purpose of managing and optimizing their performance, as well as data related to your usage of the Services. While we perform routine data backups, you are solely responsible for maintaining the data you transmit or that is connected to any activities you engage in while using the Services. You agree that we are not liable for any loss or corruption of such data, and you waive any right to take action against us for any such loss or corruption.

Intellectual Property

EXPOLEAP is the intellectual property owner of FormCoach products and services. Without the written consent of the EXPOLEAP or the relevant right holder, you may not implement, utilize or transfer the above intellectual property rights by any third party for any commercial or non-commercial purpose.

Refund Policy

Payments are non-refundable unless otherwise required by law. These Terms do not supersede any mandatory local laws concerning your right to cancel. If you need to request a refund (or partial refund), please reach out to us via the in-app messenger or by emailing us: support@formcoach.io. Once approved, refunds will be processed to the original payment method used.

Governing Law and Dispute Resolution

The laws of the Country, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

For any concerns or disputes regarding the Service, you agree to first attempt to resolve them informally by contacting the Company.
